Selling your home is a detailed process with a complex set of rules and a pile of paperwork. Luckily, this is where your Conveyancer can Resolve it for you.

 

The process

When you’re selling your home, your Conveyancer will:

  • Ensure you have a good understanding of the items included in the Contract of Sale and how they may affect you, to ensure you are getting a fair deal.
  • Coordinate the settlement date and time with both your lender and the buyer’s settlement agent.
  • Keep you informed about the progress of your settlement.
  • Conduct searches of the property through various government departments, including Landgate in WA, Land Use Victoria, council, water authority, and land tax department.
  • Ensure all taxes and rates are paid and transferred as needed.
  • Ensure a Mortgage Discharge authority form has been completed within the required timeframe.
  • Send you a statement of the funds anticipated to be received at settlement, along with any costs due to be paid by you, such as the agent’s commission and the adjustment of the rates and taxes due on the property.
  • Carry out the required verification of identity with you.
  • Prepare and verify all necessary documents required for settlement.
  • Double-check that all inspections and other special conditions in the contract have been completed and that the conditions have been met.
  • Work with your mortgage broker, lender and real estate agent or land developer to make sure finance is in order for both parties, and everyone is ready for settlement.
  • Request funds to proceed to settlement.
  • Attend settlement on your behalf and confirm when settlement is complete.
  • Prepare the final statement letter and ensure title ownership has changed to the buyer.

A settlement agent and a conveyancer are the same thing. The names used for the role may vary between states, but both are responsible for the same things during your settlement process.

In short, a conveyancer is responsible for the legal transfer of your property – into your name if you are purchasing, or into the buyer’s name if you are selling. It involves dealing with various parties involved to ensure settlement occurs smoothly and on time.

Settlement is the most exciting part of the journey. It’s the day and time when the money and ownership of the property change hands. Settlements now happen electronically via a platform called PEXA.

If you are selling a property we are legally required to identify you, meaning that you would need to come into our office. In some states, the buyer also needs to be identified – if you’re buying you can come into our office, or if it’s more convenient, go to your local Australia Post to be identified. After that, most of our correspondence is by phone and email, although you’re always welcome to come and meet with your Conveyancer at any time.

It’s simple, just make sure you insert our details in your contract of sale when you sign so the vendor knows you’re using us.
